John Yoo has been vindicated.

Note that the cost of the non-war is close to $1 billion.
He has, but the Executive should stop pretending that WPA has any force of law whatsoever. To claim that it is controlling precedent is to suggest that Constitutional crises are a structural part of political processes.

Of course, this is academic anyway b/c the enforcement of WPA in the event of a conflicts of law question would be ruled a non-justicible question even by the most hostile high court.

It does a disservice when men in government entertain fictions about express powers and the ability of the legislature to limit them by fiat, especially when nobody in government actually believes these things are operative and enforceable.
